Surah Name: Al-Mujadalah Meaning: The Pleading

  • Mujadalah literally means obstinate insistence that persists not withstanding a refusal A Companion, Aus bin as Sarmat-RAU said to his wife Khola-RAU that she was like his mother to him. Such utterance in the era of Ignorance was considered to be severer than divorce as an option of reconciliation stayed open in divorce, but it was impossible in this case. Khola-RAU brought the dispute to the Holy Prophet-SW for resolution, who told her that Allah-SWT ’s decree was not available on this particular subject. She insisted and complained that if the Divine revelation addressed all other matters, why was it silent in her case? So Allah-SWT sent the revelation and rejected this tradition by declaring it to be a lie as well as a sin and commanded to adopt the proper way of divorce, where separation was desired.
  • Allah-SWT , the Almighty had heeded the lady's request, and remedied the banal ritual she was complaining about. She sought remedy commensurate to their situation, believing that Allah-SWT hears all cries for help and is a Witness to everything.

bismillah

قَدْ سَمِعَ اللَّهُ قَوْلَ الَّتِي تُجَادِلُكَ فِي زَوْجِهَا وَتَشْتَكِي إِلَى اللَّهِ وَاللَّهُ يَسْمَعُ تَحَاوُرَكُمَا إِنَّ اللَّهَ سَمِيعٌ بَصِيرٌ

Qad samiAAa Allahu qawla allatee tujadiluka fee zawjiha watashtakee ila Allahi wa(A)llahu yasmaAAu tahawurakuma inna Allaha sameeAAun baser(un)

Surely has Allah-SWT heard the saying of her who pleaded with you-SW concerning her husband and made her plaint to Allah-SWT , and Allah-SWT has heard your-SW mutual conversation. Verily Allah-SWT is Hearing, Beholding.

(58:1)

الَّذِينَ يُظَاهِرُونَ مِنكُم مِّن نِّسَائِهِم مَّا هُنَّ أُمَّهَاتِهِمْ إِنْ أُمَّهَاتُهُمْ إِلَّا اللَّائِي وَلَدْنَهُمْ وَإِنَّهُمْ لَيَقُولُونَ مُنكَرًا مِّنَ الْقَوْلِ وَزُورًا وَإِنَّ اللَّهَ لَعَفُوٌّ غَفُورٌ

Allatheena yuthahiroona minkum min nisaihim ma hunna ommahatihim in ommahatuhum illa allaee waladnahum wainnahum layaqooloona munkaran mina alqawli wazooran wainna Allaha laAAafuwwun ghafoor(un)

As to those among you who put away their wives by pronouncing Zihar-their mothers they are not. Their mothers are only those who gave them birth; and they utter a word disreputable and false. Verily Allah-SWT is Pardoning, Forgiving.

(58:2)


وَالَّذِينَ يُظَاهِرُونَ مِن نِّسَائِهِمْ ثُمَّ يَعُودُونَ لِمَا قَالُوا فَتَحْرِيرُ رَقَبَةٍ مِّن قَبْلِ أَن يَتَمَاسَّا ذَلِكُمْ تُوعَظُونَ بِهِ وَاللَّهُ بِمَا تَعْمَلُونَ خَبِيرٌ

Wa(a)llatheena yuthahiroona min nisaihim thumma yaAAoodoona lima qaloo fatahreeru raqabatin min qabli an yatamassa thalikum tooAAathoona bihi wa(A)llahu bima taAAmaloona khabeer(un)

Those who put away their wives by pronouncing Zihar and thereafter would retract what they have said, then upon them is the freeing of a slave before they touch each other. You are exhorted to that; and Allah-SWT is Aware of whatsoever you do.

(58:3)


فَمَن لَّمْ يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ مِن قَبْلِ أَن يَتَمَاسَّا فَمَن لَّمْ يَسْتَطِعْ فَإِطْعَامُ سِتِّينَ مِسْكِينًا ذَلِكَ لِتُؤْمِنُوا بِاللَّهِ وَرَسُولِهِ وَتِلْكَ حُدُودُ اللَّهِ وَلِلْكَافِرِينَ عَذَابٌ أَلِيمٌ

Faman lam yajid fasiyamu shahrayni mutatabiAAayni min qabli an yatamassa faman lam yastatiAA faitAAamu sitteena miskeenan thalika lituminoo bi(A)llahi warasoolihi watilka hudoodu Allahi walilkafireena AAathabun aleem(un)

And whoever does not find a slave to free, on him is the fasting for two months consecutively before they touch each other, and on him who is unable to do so is the feeding of sixty indigent ones. That is in order that you may believe in Allah-SWT and His-SWT Messenger-SW . These are the ordinances of Allah-SWT , and for the infidels is an afflictive chastisement.

(58:4)


إِنَّ الَّذِينَ يُحَادُّونَ اللَّهَ وَرَسُولَهُ كُبِتُوا كَمَا كُبِتَ الَّذِينَ مِن قَبْلِهِمْ وَقَدْ أَنزَلْنَا آيَاتٍ بَيِّنَاتٍ وَلِلْكَافِرِينَ عَذَابٌ مُّهِينٌ

Inna allatheena yuhaddoona Allaha warasoolahu kubitoo kama kubita allatheena min qablihim waqad anzalna ayatin bayyinatin walilkafireena AAathabun muheen(un)

Verily those who oppose Allah-SWT and His-SWT Messenger-SW shall be abased even as those before them were abased; and surely We-SWT have sent down manifest Signs. And for the infidels is an ignominious chastisement.

(58:5)


يَوْمَ يَبْعَثُهُمُ اللَّهُ جَمِيعًا فَيُنَبِّئُهُم بِمَا عَمِلُوا أَحْصَاهُ اللَّهُ وَنَسُوهُ وَاللَّهُ عَلَى كُلِّ شَيْءٍ شَهِيدٌ

Yawma yabAAathuhumu Allahu jameeAAan fayunabbiohum bima AAamiloo ahsahu Allahu wanasoohu wa(A)llahu AAala kulli shayin shaheed(un)

On the Day when Allah-SWT will raise them all together and declare to them what they have worked. Allah-SWT has taken count thereof, while they forget it. And Allah-SWT is a Witness over everything.

Orders about Zihar


Those involved in Zihar (declaring wives as mothers, sisters, daughters etc) should beware that their wives do not become their mothers by uttering such senseless words. Mother is only she to whom one is born. Such an utterance is highly immoral and a blatant lie. They should repent and ask Allah-SWT's Forgiveness for He-SWT is Forgiving and Merciful.

 

Conditions for Intimacy


The second aspect of the issue is that if a man separates from his wife through Zihar but repents and wishes reconciliation, he would have to free one male or female slave in order to legitimatize such reunion. If that is beyond his means, he is to fast for sixty days continuously. Failing that due to sickness or old age etc, he should feed sixty destitute. This penalty is aimed at making you realize and that you do not repeat the stupidity in future. Remember that Allah-SWT Knows whatever you do and is a Witness over all your decisions. This punishment besides an admonition would also strengthen your faith in Him-SWT and His-SWT Prophet-SW for these are the limits Allah-SWT has laid down and the infidels neglecting these would suffer agonizing torment.

 

Hudud are not mere Punishments


It has also become clear that the scope of Islamic Hudud and punishments extends beyond advice and reform, to the strengthening of faith. After a believer is purified through the punishment for his misdeeds, his faith grows in fervour, which is far more valuable than social reformation. A point to ponder for those who term these punishments as barbaric.

 

Repercussions of Opposing the Holy Prophet-SW


Those who oppose Allah-SWT and His-SWT Prophet-SAAW are not only doomed in the Akhirah, but also face disgrace in whichever worldly pursuit they disobey. This is a fact amply supported by history as well as by the contemporary West, where aversion to Allah-SWT ’s laws in issues related to the economics and morality has resulted in utter degeneration of the society. Moreover, a degrading retribution awaits them in the Akhirah, for the day of accountability is fast approaching. A majority of them would have forgotten their crimes or given no importance to these though all are recorded and uptodate with Allah-SWT .
